Welcome to Vaypoint. These Terms of Service ("Terms") govern your access to and use of the Vaypoint website and services. Please read these Terms carefully before using our services.

1. Acceptance of Terms

By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.

2. Description of Service

Vaypoint is a map-first creator platform that enables travel content creators to organize and share their travel and food content by location. Our services include:

• Interactive map-based profile pages for creators
• Location pinning for cross-platform content (Instagram, YouTube, blogs)
• Itinerary and road trip planning tools
• Discovery features for followers to explore recommendations
• Analytics and audience engagement tools

3. Changes to Terms

We may modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after the changes are made constitutes your acceptance of the updated Terms.

4. Account Registration

To use certain features of our services, you may need to create an account. Vaypoint uses passwordless sign-in — a one-time code sent to your email address, or Google sign-in — so there is no password to set or store. You are responsible for:

• Providing accurate, current, and complete information when you register, and keeping it up to date.
• Maintaining control of the email account (or Google account) you sign in with. Because sign-in is passwordless, access to your email inbox is what secures your Vaypoint account — anyone who can receive mail at your address, or access your linked Google account, can sign in as you.
• All activity that occurs under your account.
• Promptly notifying us at info@vaypoint.com of any unauthorized access or security concern.
• Ensuring you are at least 13 years old (or the age of digital consent in your jurisdiction).

You may not share your sign-in access, impersonate any person or entity, or maintain multiple accounts for abusive purposes.

5. Creator Content & Licensing

Ownership: You retain full ownership of all content you create and upload to Vaypoint, including posts, itineraries, road trips, location data, images, and descriptions ("Creator Content").

License to Vaypoint: By uploading Creator Content, you grant Vaypoint a non-exclusive, royalty-free, worldwide, sublicensable license to:

• Display your content on your public profile and throughout the Vaypoint platform
• Feature your content in discovery, search, and recommendation features
• Create thumbnails, previews, and excerpts for promotional purposes
• Store and backup your content on our servers

This license terminates when you delete your content or account, except for content that has been shared or embedded by other users.

You represent and warrant that:

• You own or have the necessary rights to your Creator Content
• Your Creator Content does not violate the rights of any third party
• Your Creator Content complies with these Terms and all applicable laws

Prohibited Content: You may not upload content that contains hate speech, harassment, illegal activities, spam, malware, or content that infringes on others' intellectual property rights.

6. Prohibited Conduct

You agree not to:

• Violate any applicable law or regulation
• Infringe the rights of others
• Submit false or misleading information
• Impersonate any person or entity
• Interfere with or disrupt our services
• Attempt to gain unauthorized access to our systems
• Use our services for any illegal or unauthorized purpose
• Engage in any activity that could harm our services or other users

7. Intellectual Property

Our services and all content, features, and functionality thereof, except for Creator Content, are owned by Vaypoint or its licensors and are protected by copyright, trademark, and other intellectual property laws. The Vaypoint name, logo, and all related marks are trademarks of Vaypoint.

8. Affiliate Links & Monetization

Vaypoint may offer features that allow creators to include affiliate links or monetize their content. When using these features:

• You must comply with all applicable disclosure requirements (e.g., FTC guidelines)
• Affiliate relationships must be clearly disclosed to your audience
• You are responsible for any tax obligations arising from your earnings
• Vaypoint reserves the right to modify commission structures with notice

9. Termination & Suspension

We may terminate or suspend your account and access to our services at any time, without prior notice or liability, for any reason, including if you breach these Terms.

10. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Vaypoint shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
